Provider: Mahdi for Programming and Investment SPC (OmniLeb Tech), Airport Heights 128, Ghala, Building 128, 6th Floor, Apartment 64, Muscat 1111, Oman, email: ahmdberro50@gmail.com.
Further details are in the Impressum.

The app presents these terms for acceptance on first launch; the text below is the same.

1. Scope and who you contract with

These Terms of Use apply to the Streckenblick app on iPhone and Android, including its display through Apple CarPlay, Android Auto and Android Automotive, and to the server services the app uses (together, the "Service"). The provider of the Service, and your contracting party for its use, is the company named in the Impressum ("we"). The Impressum is available at any time in the app under Settings → Legal and at streckenblick.de/impressum.

You obtain the app from Apple's App Store or from Google Play. Paid purchases in the app are made with the relevant store as the seller — Apple Distribution International Ltd. in the App Store, Google Commerce Limited on Google Play, both in Ireland — and their terms also apply to the purchase. These Terms of Use govern how you may use the app and the Service.

There is no account with a name, email address or password.

2. What the app is — an aid, not a guarantee

Streckenblick is a navigation and information app. It shows maps, routes, speed limits, roadworks, traffic jams, hazards reported by other users and — depending on the country — the locations of traffic enforcement installations.

The app is an aid. It does not replace attentive driving, the road signs in front of you, or your own judgement. Where the app and the road disagree, the road is right.

The data shown comes from our own surveys, from public and licensed sources and from reports by other users. We do not warrant that it is complete, current or correct at every location. Installations may be removed, moved, newly built or switched off without that being reflected in the data immediately; speed limits shown where the data holds no sign are statutory defaults and are marked as such. The absence of an indication does not mean nothing is there; the presence of one does not mean something is. Do not make any decision in traffic on the basis of this data alone.

3. Traffic enforcement and the law of the country you drive in

Whether an app may show traffic enforcement measures while driving is decided by each country, and the rules are often addressed to the person driving. In Germany, for example, section 23(1c) of the Road Traffic Regulations (StVO) provides that a person driving a vehicle must not use the relevant functions of technical devices that can also be used to indicate traffic enforcement measures. Other countries prohibit such indications entirely, restrict them to larger zones, or permit them.

The app assigns each country one of four presentations: full (individual locations and alerts), zones only (larger areas, no individual locations), hidden while driving (shown only when stationary), or off (no data for that country, not even on the device). A country without an assignment is treated as off. We maintain the assignment on our own assessment; it is not legal advice and not an assurance that a function may be used while driving in the country concerned. The assignment may change; at present some countries are assigned the full presentation and others zones only, and every other country, including any country for which we have no documented legal basis for showing such locations, is treated as off.

You are responsible for knowing and observing the law of every country you drive in, and for not using functions whose use while driving is prohibited there. You can switch off individual kinds of indication in Settings. Do not operate the app in any way that distracts you from the traffic.

4. Free trial and the Plus subscription

Once you have accepted these terms you can use Streckenblick in full, once, for 30 days without a purchase and without payment details. The trial is available only once per device, including after a reinstall. After it, the paid functions are available only with Streckenblick Plus; the app shows which functions these are before you buy.

Plus is offered as a yearly subscription through the App Store or Google Play. The price, the term and any free introductory period offered by the store are shown to you in the store's purchase dialog before you buy. If you take up such an introductory period, it converts into the paid yearly subscription when it ends unless you cancel beforehand.

The subscription renews for one year at a time unless you cancel it in good time before the end of the current period — in the App Store at least 24 hours before it ends, on Google Play before it ends. You are billed through your store account. After cancelling, Plus stays active until the end of the period you have paid for.

Because the store is the seller, you cancel there, not with us: in the App Store under Settings → Apple Account → Subscriptions, on Google Play under Payments & subscriptions → Subscriptions. The app takes you there directly through "Manage subscription". The obligation to let you cancel electronically (section 312k of the German Civil Code, BGB) rests with the store as your contracting party, which meets it with this subscription management.

5. Right of withdrawal and refunds

As a consumer you have a statutory right to withdraw from purchases in the app within fourteen days. It exists against the store, which is the seller, and you exercise it in the way the store provides — in the App Store through the purchase history of your Apple Account, on Google Play through the order history of your Google Account. The electronic withdrawal function under section 356a BGB is likewise for the store, as the seller, to provide.

For digital content the right of withdrawal can expire early if, in the purchase dialog, you expressly agree that provision may begin before the withdrawal period ends, confirm that you know you thereby lose the right, and the store confirms the contract to you on a durable medium (section 356(6) BGB). Merely using the app does not have that effect.

We do not process payments and therefore cannot issue refunds ourselves. Payment, cancellation and refunds are handled by the store under its terms. Your statutory rights are unaffected.

6. Referral codes

A referral code lets you receive Plus free of charge for a stated period. A code can be used once, expires shortly after it is issued, and is tied to the account that redeems it; no more than one referral runs on an account at a time. A period granted by a code does not renew, costs nothing, and ends without cancellation. It has no cash value, cannot be transferred and is not paid out.

We may refuse codes obtained or redeemed by deception, by automated means or in circumvention of these rules, and end any unlock granted with them.

7. Your reports, confirmations and comments

You can report hazards and enforcement checks, confirm existing indications or mark them as gone, and write comments on indications. Reports, confirmations and comments are shown to other users without a name.

You confirm that what you submit is accurate to the best of your knowledge and that you do not submit it in a driving situation where doing so would endanger you or others. In particular, the following are prohibited: deliberately false reports; unlawful content; insults, threats and incitement; details by which other people can be identified, such as names or number plates; advertising and links; and generating reports or votes by automated means.

For your comments you grant us the non-exclusive, royalty-free, worldwide right to store them in the Service, to show them to other users and to adapt them technically for that purpose, for as long as they are stored in the Service. You can delete a comment of your own at any time on the device you wrote it on. Reports and confirmations are statements of fact without the character of a work; they expire within the periods stated in the Privacy Policy.

Whether a report is shown, and for how long, follows automatically from the confirmations and denials of other users. We do not monitor content generally, but we review content that is flagged to us and remove content that is unlawful or breaches these terms. Repeated or serious breaches may lead to exclusion from reporting or from the Service (section 12).

8. Notices of illegal content (Digital Services Act)

For reports and comments we are a provider of hosting services within the meaning of Regulation (EU) 2022/2065 (Digital Services Act). You can flag a comment you consider unlawful, or in breach of these terms, directly in the app with "Report". Notices about other content are sent electronically to the email address given in the Impressum; identify the content as precisely as you can (location, kind, time, wording), explain why it is unlawful, and — except for notices concerning certain offences against children — give your name and email address so that we can reply.

We handle notices promptly, diligently and objectively and tell you our decision if you have given us contact details. If we remove or restrict content, we give reasons to the person who submitted it to the extent we know their electronic contact details; since reports and comments are submitted without contact details, that is usually not possible.

The point of contact for authorities, the European Commission and users under Articles 11 and 12 DSA is the email address given in the Impressum; communication is possible in German and English. Where the Impressum names a legal representative under Article 13 DSA, that representative may also be addressed on these matters.

9. Rights of use in the app and the data

We grant you the non-exclusive, non-transferable right to use the app for your own, non-commercial purposes on devices you own or control, within the usage rules of the store you obtained it from. The data remains ours or that of the respective rights holders; the databases are protected as such under sections 87a et seq. of the German Copyright Act (UrhG). Map data: © OpenStreetMap contributors (ODbL).

The following are prohibited: systematic extraction or copying of the databases, whether by hand or by automated means; passing on, publishing or reselling the data; reverse engineering, decompiling or modifying the app except to the extent the law expressly permits (sections 69d and 69e UrhG); circumventing technical protection measures, including the device check and the signing of requests; and any use that disrupts the operation of the Service.

10. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, for fraudulent concealment of a defect, and to the extent we have given a guarantee.

For ordinary negligence we are liable only for breach of a material contractual obligation — an obligation whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely — and then limited to the foreseeable damage typical for this type of contract.

Our liability is otherwise excluded. This includes fines, driving bans, penalty points and other consequences arising from your own conduct in traffic, unless they result from a breach of duty for which we are liable under the preceding sentences. These limitations also apply for the benefit of our staff and agents.

Your statutory rights in respect of defects in the digital product (sections 327 et seq. BGB) are unaffected; they lie against the store as the seller. Nothing in these terms limits liability that cannot be limited by law.

11. Terms specific to the App Store and Google Play

If you obtained the app from the App Store, the following also applies. These terms are concluded between you and us only, not with Apple. We alone are responsible for the app and its content, and for maintenance and support; Apple has no obligation to provide them. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. We, not Apple, are responsible for addressing any claims by you or third parties relating to the app — including product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, claims under consumer protection law, and claims that the app infringes third-party rights, including intellectual property rights. You represent that you are not located in a country subject to a United States Government embargo or designated by it as a "terrorist supporting" country, and that you are not listed on any United States Government list of prohibited or restricted parties. You must comply with applicable third-party terms when using the app, such as those of your mobile carrier. Apple and its subsidiaries are third-party beneficiaries of these terms and, once you have accepted them, may enforce them against you as third-party beneficiaries.

If you obtained the app from Google Play, the Google Play Terms of Service also apply to purchases. Google is not a party to these terms.

Direct questions, complaints and claims about the app to us; our address and email address are in the Impressum.

12. Availability, changes and termination

We aim for continuous operation but do not owe it; maintenance and faults are possible. We change the range of functions only for a valid reason — such as a change in the law, in data licences or in security requirements — at no extra cost to you and with clear information; if such a change impairs a paid Plus more than insignificantly, you have the rights under section 327r BGB.

We change these terms only for a valid reason — such as a change in the law, in case law, in the Service or in our own circumstances. The amended version is put to you in the app and applies only once you accept it. If you do not accept it, you may stop using the Service; a period you have already paid for is unaffected.

You may stop using the Service at any time and delete the app; you cancel a subscription with the store. We may suspend access to reporting and commenting, or to the Service, for good cause, in particular for repeated abusive reporting, unlawful content, automated extraction of our data or circumvention of technical protection measures. Where reasonable, we warn you first.

13. Governing law, jurisdiction and dispute resolution

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in a member state of the European Union or the European Economic Area, you additionally keep the protection of the mandatory consumer protection provisions of that state (Article 6(2) of the Rome I Regulation).

As a consumer you may sue us in the courts of the place where you are domiciled, or in the courts at our seat; we may sue you only in the courts of the state in which you are domiciled (Article 18 of Regulation (EU) No 1215/2012). We make no other agreement on jurisdiction with consumers.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

If any provision of these terms is or becomes invalid, the remainder of the contract stays in force, and the statutory rules take the place of the invalid provision.

14. Language and the record of your acceptance

These terms exist in several languages. The German version governs; the others are provided for convenience.

The date and version of the text you accept are stored on this device, so that it remains clear which wording you agreed to and when. The current text is always available in the app under Settings → Legal and at streckenblick.de/terms.
